The Musée des Augustins, a fine art museum and historic monument located at 21 rue de Metz, 31000 Toulouse, falls under the responsibility of the Direction des musées et monuments de la Mairie de Toulouse [Toulouse city council, museums and monuments department].

These General Terms and Conditions of Sale apply automatically and without restriction to all purchases of admission tickets and activities for individuals and groups from the Musée des Augustins. It is understood that the purchase of admission tickets and activities, for individuals or groups, implies the Buyer’s unqualified acceptance of these General Terms and Conditions of Sale.
Article 1 – GENERAL PRINCIPLES
1.1 Definitions
Every natural person or legal entity, of legal age and capacity, who wishes to use the online or direct telephone sales services and who meets the conditions of these General Terms and Conditions will hereinafter be referred to as “THE BUYER”.
Every admission ticket or activity purchased by a Buyer from the website under the terms and conditions set out hereunder will hereinafter be referred to as “THE ORDER” or “THE PRODUCTS”.
These General Terms and Conditions of Sale for the Musée des Augustins set out the rights and obligations of the parties within the context of the sale of admission tickets or activities to Buyers.
1.2 Ticket purchasing terms
The website https://billetterie.musee-augustins.toulouse.fr/ provides access to the Musée des Augustins online ticketing service, which sells admission tickets and activities for the Musée des Augustins in real time.
Admission tickets and activities can also be purchased from the Musée des Augustins reception desk. The Buyer declares that they have reviewed and accept the rights and obligations hereunder.
Article 2 – SPECIAL TERMS AND CONDITIONS AND HOSTING THE GENERAL PUBLIC
2.1. 2.1. Opening hours and location
The date, place and time are indicated on the ticket.
Activities start promptly at the scheduled time: please arrive at the Musée des Augustins 15 minutes before your activity begins. On account of artistic restrictions inherent to certain activities, late arrivals may not be able to join the activity. In this case, visitors will not receive refunds for their tickets.
2.2. 2.2. Interruption, changes and cancellation

Visitors will receive a refund if an activity is interrupted by the Musée des Augustins.
Visitors will not receive a refund if they interrupt an activity.
2.2.2. Changes
If the date, time or location of an activity is changed, and if such a change does not suit the visitor, the Musée des Augustins undertakes to refund the visitor.
2.2.3. Cancellation
Admission tickets and activities may not be returned, exchanged or refunded unless cancelled by the facility.
Tickets cannot be refunded if they are lost or stolen.
They cannot be resold to third parties.
The Buyer cannot cancel their purchase once payment for the tickets has gone through. Cancellation is therefore impossible once the Buyer has paid for the tickets.
If the Musée des Augustins is unexpectedly closed or the activity is cancelled, and if the Musée des Augustins decides to issue refunds for the tickets, it will issue such refunds under the terms and conditions set out in article 10.2 of these General Terms and Conditions of Sale. In this case, only the price stated on the ticket will be refunded, to the exclusion of ancillary costs (including, but not limited to, transport costs, hotel costs and parking fees).
If the cancellation is the result of the occurrence of a force majeure event as defined by the law and case law (including, but not limited to, bad weather, strikes, fire, water damage, illness of a performer or an epidemic), the visitor may choose to request either an exchange or a refund.
Article 3. PRICES

The Product prices are stated in euros, inclusive of all taxes and processing fees.

Different rates may be available. For some rates, supporting documents may be requested according to the terms and conditions indicated on the website.

Prices are given in euros, inclusive of taxes. They are decided on the basis of the rates in force established by the municipal board of the Mairie de Toulouse. The Musée des Augustins may therefore be required to amend its prices further to a decision of the municipal board.

All orders, regardless of their origin, are payable in euros.
Article 4. AVAILABILITY AND ORDERS
4.1 Availability
Products are purchased in real time. As such, the ticket office informs the Buyer in real time of Product availability at the time the order is placed.
4.2 Purchase terms
Tickets are not subject to return, exchange or refund. The Buyer must, when the ticket is delivered, check the name, date and time of the activity, as well as the price appearing on the ticket.
For concessions, a valid supporting document must be provided. No reduction will be applied once payment has been made for the order.
The price, inclusive of all taxes for each Product, is indicated in the description of the selected activity.
4.3 Order confirmation
For orders placed online, at the time of ordering via the online ticketing site, the “Order Summary” page allows the Buyer to check the number of Products ordered and the delivery arrangements. The availability of Products can therefore only be assessed at the time the order is definitively confirmed. By clicking the “Confirm order” button, the Buyer declares their full and unqualified acceptance of these General Terms and Conditions of Sale.
After confirming the contents of their order, the Buyer finalises it by proceeding to payment. The order becomes final only once the corresponding payment has been made. No modification or cancellation of the order will be possible thereafter.
Article 5. PAYMENT
Payment by bank card is the only method accepted for online purchases.
Payment by bank card enables the Buyer to purchase Products online immediately in a firm and final manner. We accept cards for the payment of orders from the Carte Bleue/Visa and Eurocard/Mastercard networks.
The Buyer’s bank account will be debited immediately for the total amount of the tickets, including all charges, in euros. The order will be considered effective once confirmation has been received from the banking payment centres.
In accordance with current regulations, and to ensure the security and confidentiality of information, the Musée des Augustins does not store Buyers’ banking details.
When placing an order on the Musée des Augustins website, it is the Buyer’s responsibility to save and print their payment confirmation if they wish to retain details of their banking information and transaction.
Article 6. SECURING PAYMENTS AND PERSONAL DATA
Online payment security is provided by Ogone, a PCI DSS-certified service provider specialising in online payment security. SecuTix guarantees the complete confidentiality of the Buyer’s banking details and systematically checks the validity of access rights during payments by bank card and encrypts all exchanges to ensure confidentiality.
Article 7. CONFIRMING AND APPROVING ORDERS
Product orders are only definitively confirmed and binding on the Musée des Augustins upon receipt of an email confirming that the order has been approved.
Consequently, the Buyer is invited to consult their inbox and, where appropriate, their spam folder.
The Buyer declares that they have reviewed and accepted these General Terms and Conditions of Sale before placing an order. Approval of the order, therefore, entails acceptance of these General Terms and Conditions of Sale.
The Buyer’s failure to fulfil the obligations under the terms hereof and in particular concerning any incident regarding the payment of the price of an order, may lead to the suspension of access to the Buyer area of the Musée des Augustins online ticketing site, without prejudice to any damages the Buyer may seek. Consequently, the Musée des Augustins reserves the right to refuse any order from a Buyer with whom it is in dispute.
Article 8. OBTAINING PRODUCTS
8.1 Printing tickets at home (e-ticket).
8.1.1 E-tickets can be printed on a standard printer with internet access. They enable the Buyer to obtain their tickets instantaneously, without having to wait to receive them by post or having to visit a point of sale in person.
8.1.2 To be considered valid, the ticket must be printed in portrait mode on a sheet of white A4 paper, blank on both sides. Each place purchased corresponds to one ticket.
8.1.3 This ticket cannot be exchanged or refunded. It is personal and cannot be transferred.
8.1.4 E-tickets display a barcode or a unique QR code. Tickets are checked upon entry. It is impossible to be allowed entry multiple times with the same ticket. Only the first person to present the ticket will be granted entry. That person is considered the legitimate bearer of the ticket. Reproducing, duplicating or forging the ticket in any way whatsoever, or making it available for such purposes, is prohibited. Reselling the ticket at a price higher than that indicated on the ticket is prohibited under the law of 27 June 1919. The Musée des Augustins can refuse entry when several printouts, reproductions, copies or imitations of an e-ticket are found to be in circulation and that access has already been granted to the holder of a printout, reproduction, copy or imitation of a corresponding e-ticket. It should be noted that the Musée des Augustins is not obliged to verify the identity of the person presenting an e-ticket to check that such person is indeed the Buyer of the tickets, nor to check the authenticity of the e-ticket insofar as the imitation or copy cannot be irrefutably identified as such during an inspection upon arrival. If the holder of an e-ticket is prevented from entering for this reason during a ticket inspection, there exists no right to a refund of the price paid.
The Musée des Augustins declines all liability, particularly in the event of an anomaly arising during the order, processing or printing of the e-ticket, insofar as it has not caused such intentionally or further to negligence in the case of loss, theft or unlawful use of the e-ticket. The Buyer will not be given any duplicate or certificate, or ticket reissue , of any type whatsoever, other than the sole initial ticket available for the Buyer to print.

The Buyer can present their e-ticket on a smartphone for inspection upon arrival to verify the validity of the QR code.

Article 10. DUPLICATE – REFUND

A ticket cannot be resold at a price higher than that indicated on the front of said ticket or activity registration.

A ticket cannot be refunded, even in the event of loss or theft, returned or exchanged, unless an activity is cancelled or the museum is unexpectedly closed under the terms and conditions set out in article 2.2.3. hereof. In such circumstances, the price of the ticket or registration fee only will be refunded, excluding processing and postage fees. This refund will only be paid to the initial Buyer in return for the ticket or activity registration. Under no circumstances will any processing fees of any nature whatsoever be refunded or paid as compensation.

These General Terms and Conditions of Sale were originally written in French and will be performed and construed under French law. The same applies to the sale of the Products hereunder, which is subject to French law. In the event of a legal dispute, the French courts will alone have jurisdiction.

Article 14. AMENDMENT OF THE GENERAL TERMS AND CONDITIONS OF SALE
The Musée des Augustins reserves the right to amend these General Terms and Conditions of Sale.
Should any one of the terms of these General Terms and Conditions of Sale be considered illegal or unenforceable by court decision, the other provisions will remain in force.
Article 15. OTHER PROVISIONS
The information provided on the Musée des Augustins website is binding between the parties. Elements such as the time of receipt or transmission, as well as the quality of the data received, will take precedence as recorded in the Musée des Augustins’ IT systems, or as authenticated by its electronic procedures, unless the Buyer provides written evidence to the contrary. The evidential value of information provided by the Musée des Augustins’ IT systems is equivalent to that of an original document, in the same way as a paper document bearing a handwritten signature.

Article 17. DATA PROTECTION – CNIL
17.1 Personal data protection
The Buyer must provide certain information of a personal nature in order to place a Product order.
The collected data are processed electronically for management of the ticket office and newsletters. The Mairie de Toulouse is the data controller, represented by the Musée des Augustins. Only authorised staff and the Toulouse Direction des finances [finance department] have access to the data, which will be retained for the duration of the Buyer’s account.
In accordance with current personal data protection legislation (French data freedom law of 6 January 1978), you have the right to access, amend and rectify personal data concerning you. You can also object to the processing of your data.
You can exercise your rights by sending an email to reservation.augustins@culture.toulouse.fr, stating the surname, first name, postal address, email address and, if possible, buyer reference. The message must be signed and accompanied by a photocopy of a proof of identity bearing the Buyer’s signature. It must also specify the address to which a reply should be sent. A reply will be sent within one month of receipt of the request.
You can object to the processing of your personal data and have the right to submit a complaint to the Commission nationale de l’informatique et des libertés (CNIL, France’s data protection authority). The legal basis for such processing is consent.
For online sales sites, the Mairie de Toulouse has submitted a declaration to the CNIL. The CNIL request is under review. The Musée des Augustins undertakes to observe the confidential nature of the personal data disclosed by the Buyer on the Musée des Augustins website and by telephone, and to process them in line with the French data freedom law of 6 January 1978.
The information and data are retained for security purposes to comply with legal and regulatory requirements, to enable the proper management of orders and sales transactions, and to improve and customise the services offered by the Musée des Augustins and the information shared by :
• Informing the Buyer of upcoming sales and events, by sending invitations by email ;
• Processing orders placed by the Buyer (dispatch of tickets, contact in the event of a cancellation, date, time or place change of a performance for which the Buyer has reserved tickets) ;
• Improving and customising communications, primarily through the sending of newsletters, any special offers and special emails related to the preferences indicated by the Buyer.
In addition, the Musée des Augustins reminds the Buyer that if they have changed their mind and no longer want to receive such information, they can at any time send a request to the following email address : reservation.augustins@culture.toulouse.fr
